Terms of service

1. Who you are contracting with

Sandbox by Sable (“Sandbox”, “we”) is operated by Smiles Consulting. These terms apply to your use of the Sandbox web application and anything you produce with it. Sandbox is sold to businesses; it is not a consumer service, and the statutory rights that apply to consumer contracts do not apply here.

2. What the service does

Sandbox builds property brochures from details you enter, on a fixed page layout, and exports them as PDFs. Some copy is drafted for you by an automated system. That draft is a starting point and not a statement of fact about any property: you are responsible for checking every word of a brochure before you publish or distribute it, including any measurement, price, tenure, EPC rating or description of a property or its surroundings.

You remain solely responsible for compliance with the Consumer Protection from Unfair Trading Regulations, the Estate Agents Act, National Trading Standards guidance on material information, and any other rules that apply to property marketing in your jurisdiction.

3. Free use, and when you start paying

You can build brochures without an account and without a card, for as long as you like and for as many properties as you like. Nothing is charged and nothing is limited while you are building.

Exporting a brochure as a PDF requires a subscription. It begins with a 14-day free trial. We take your card details at the start of the trial and charge the first payment when it ends. Cancel at any point before the trial ends and you are not charged.

4. Price, VAT and renewal

The subscription is £99 per month, inclusive of UK VAT at the prevailing rate, charged monthly in advance and renewing automatically until cancelled. We may change the price by giving you at least 30 days’ notice by email; if you do not accept the change you may cancel before it takes effect.

Payments are handled by Stripe. We do not see or store your card number.

5. Cancelling

You can cancel at any time from your account settings. Cancellation takes effect at the end of the period you have already paid for; we do not refund part-months. After cancellation you keep access to the editor and to everything you have built, and you can carry on editing it. What stops is exporting: you will need an active subscription to produce a PDF again. Your free brochure remains downloadable.

6. Bespoke templates

Subscribers on a paid plan are entitled to one bespoke brochure template designed by our studio, with up to two rounds of revisions. Revisions mean changes to the design we have produced against the brief you gave us; a change of brief is new work. We will agree timings with you when the work starts. This entitlement is per account, is not transferable, and has no cash value.

7. Your content

You keep ownership of the property details, photographs and text you upload, and of the finished brochures. You grant us only the licence we need to host, process and render that material in order to provide the service.

You confirm you have the right to use every photograph you upload. Photographs of property interiors are very often owned by the photographer rather than the agent, and we have no way to check this for you.

8. Acceptable use

Do not use Sandbox to produce material that is misleading, that infringes someone else’s rights, or that is unlawful. Do not attempt to access another account’s data, circumvent the export limits, or resell access to the service. We may suspend an account that does.

9. Availability and liability

We aim to keep Sandbox available but do not guarantee uninterrupted service, and we may change or withdraw features. Nothing in these terms limits liability for death or personal injury caused by negligence, or for fraud.

Subject to that, we are not liable for loss of profit, loss of business, loss of goodwill or any indirect loss, and our total liability to you in any twelve-month period is limited to the amount you paid us in that period. In particular, we are not liable for the consequences of a brochure you published without checking it.

10. Ending the agreement

Either of us may end this agreement at any time. If we end it other than because you have broken these terms, we will refund any part of a month you have paid for and not used. You will have at least 30 days to export your work before your data is deleted.

11. Law

These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
